Regulation 95 - Contract-making suspended by challenge to award decision
In accordance with this Regulation, under certain situations an award decision is suspended and the contracting authority is barred from entering into the contract. The conditions are set in paragraph 1, where it is set that if an award challenge is lodged and a claim form issued and served to the contracting authority, the latter is under the obligation of not entering into the contract, in case it has not done so yet.
This ban remains in place until either an interim order is issued by the court as per Regulation 96(1) or a first instance decision is produced lifting the order.
